Urgent Letter to All Supporters of Beneficial Use

To All Supporters of CCP Beneficial Use:
 
As you know, the U.S. Environmental Protection Agency has published a proposal for regulation of coal combustion product (CCP) disposal.  The EPA is accepting public comments on the proposal until September 20, 2010.  Not only is disposal addressed in this document, but some beneficial uses are being questioned as legitimate and there is the possibility that CCP intended for disposal will be regulated as a hazardous waste.  A hazardous waste regulation of any kind will place a stain or stigma on CCP and cripple continued beneficial use.
 
Your support for continued beneficial use of CCP must be heard by the EPA. There are three ways that you can act to make your voice heard…
 
1. IMMEDIATELY SEND A QUICK LETTER FOR ENTRY INTO THE PROPOSAL DOCKET.  
Two websites have model letters and instructions for your use. The Utility Solid Waste Activities Group and Citizens for Recycling First have set up an easy-to-use process. Links to these sites are below and on the ACAA website www.acaa-usa.org 
 
Who should send a letter?  First YOU as an interested party. Second, encourage your CO-WORKERS in your organization to participate.  Plan a day on which your entire staff takes a few minutes to submit a letter from both sites.  Third, encourage your CUSTOMERS AND SUPPLIERS to participate. Finally, be sure to include FAMILY AND SOCIAL CONTACTS - spouses, children, in-laws, out-laws, friends, acquaintances, and any other social contacts you have. 
 
The volume of these letters submitted to the docket is critical.  Environmental advocacy groups have mounted similar campaigns. Earthjustice has set a goal of 50,000 letters supporting hazardous waste regulations.  And that is only one of the groups opposing continued beneficial use.

2. SEND YOUR OWN PERSONAL LETTER PRIOR TO THE CLOSE OF THE PUBLIC COMMENT PERIOD.

3. ATTEND A PUBLIC HEARING.  
The EPA will hold public hearings beginning on August 30, 2010. Interested parties will be allowed up to 3 minutes to express their views on the proposal.  While testimony is very important it is also important for the EPA to see the supporters of beneficial use at these events.  The schedule of the hearings follows along with the ACAA site coordinator.

The ACAA will have promotional items available for attendees so your support will be obvious to the EPA staff.  Again, large turnout is important.  Be assured that those in opposition to continued beneficial use will be around.
 
The effort to protect our industry requires your participation now.  If the EPA creates a bad regulation for disposal it will be almost impossible to repair the damage.  
 
The time has come for action.
